    Tucson adopts strict zoning ordinance requiring review for all large data centers

    On August 5, 2026, the Tucson City Council voted 6-1 to adopt a zoning ordinance that eliminates by-right approval for large data centers and requires all major facilities to undergo Planned Area Development or Planned Community Development rezoning, including neighborhood meetings, zoning examiner hearings, and council votes. The ordinance, effective September 4, 2026, mandates data centers be sited at least half a mile from homes and schools, restricts potable water use for cooling, limits backup generators to actual outages and scheduled tests, and requires significant open space or equivalent land conservation. The council chose this regulatory framework over an outright ban due to legal constraints from Arizona's Proposition 207 private property rights law, though it directed staff to explore whether a total ban could survive legal challenge.
